EB3 skilled and non-skilled worker

This Visa allows an employer to petition for a foreign national because the employer is unable to find a willing and able employee in the United States. Under this petition, the employer creates a job with the department of labor. The position must be advertised to the public. The overall process takes approximately 12-18 months depending on visa availability. This petition is for a Green Card (Legal Permanent Residency) for the Beneficiary and their family.

H-1B, Specialty Occupation

This is a visa for foreign nationals with a bachelors degree, or it's equivalent, or above. There are 65,000 visas allotted per fiscal year, with approximately 200,000 application every year. Employers may only apply on April 1st of every year. The visa is valid for an initial 3 years and may be extended for another 3 years for a maximum of 6 years. The Employer must show a need for this position and the Beneficiary is qualified to work in this specialty occupation. Individuals with a Masters degree from the United States are allocated an additional 20,000 visas. 

 

H-2A Temporary Agricultural

This visa allows a US employer to bring foreign nationals to the US for agricultural positions. The foreign nationals will fill seasonal and temporary agricultural job for which US workers are not available. There are restrictions the employer must abide by, such as: providing housing and meals; and guaranteed pay. The process takes at minimum 2 months and can take up to 6 months. There are visa allotments issued each year. The foreign national may stay for a period of year at a time and you may renew every year for a maximum period of 3 years. 

 

H-2B Temporary Non-Agricultural

This is similar to the H-2A visa, however it does not involve agricultural. (Resort and Hospitality Services, Retail Sales, Landscaping, Construction, etc.). It must be temporary. Same process as the H-2A, however this is subject to visa annual allotments. The process takes approximately 4-6 months.
